The presiding judge of the Kano State Upper Shari’ah Court, Justice Ibrahim Sarki Yola, who presided over the case of a Kano controversial cleric, Sheikh Abduljabar Nasiru Kabara, over alleged defamation and blasphemous statements against the Holy Prophet, has ordered psychiatrist evaluation of Sheikh Abduljabar Nasiru Kabara after he remained mute when asked questions.
Sheik Kabara was asked by his counsel, Sale Bagoro, to remain silent on questions asked him by the Justice Yola on four fresh charges filed by the Kano State Government.
The Kano State Government lead counsel, Suraj Said, filed the fresh charges against Sheik Kabara and that created misunderstanding between the defendant’s counsel and the state government counsel.
Trouble started when the presiding judge agreed to approve the inclusion of the fresh charges filed by the lawyers representing Kano state government only if the accused answered in the affirmative or rejected the charges.
Lawyers to Sheikh Kabara, who objected to the fresh charges and told him not to respond to whatever was slammed against him, led to his keeping mute when questions were asked him by Justice Yola.
The judge overruled objections and ordered Sheik Kabara to respond to the new charges, but he kept mute.
The Judge fixed September 2nd, 2021 to deliver his ruling on the eligibility of four SANs to continue with the prosecution of Sheikh Abduljabbar Nasiru Kabara.
The lead counsel to the Kano State Government, Suraj Sa’aida had, while tendering the Fiat Instrument to the court on the instruction of Attorney General and Commissioner for Justice, Musa Abdullahi Lawan, urged the court to terminate the First Information Report earlier presented to the court by Police when the defendant was first arraigned on 16th July, 2021 and granted leave to the prosecution to read the prepared charge to Abduljabbar Kabara.
Yola adjourned the case to September 16th, 2021 for continued hearing and to enable the court to receive the health report of the Sheikh.
